TLATA/Co-Habitation Disputes

Matthew does not undertake matrimonial disputes or ancillary relief work, but has invaluable experience of claims under the Trusts of Land and Appointment of Trustees Act 1996 (TLATA), the Inheritance (Provision for Family and Dependants) Act 1975 (IPFDA) and those brought with reference to other equitable and restitution principles.

Matthew offers tactically astute advice on practice and procedure relating to TLATA and IPFDA for solicitors engaged in disputes between cohabiting and other unmarried couples and claims on behalf of dependents. He has an in depth knowledge of the legal concepts which may apply in these situations, including express, resulting and constructive trusts. Matthew also provides specialist advice on charging and insolvency considerations (where disputes arise with lenders and receivers).
